Terms & Conditions

Please take a moment to review the following Terms and Conditions. These Terms and Conditions (“Agreement”) apply to your use of this website (sxmexcursions.com) and the booking services provided by SXM Excursions Inc. By using this site (sxmexcursions.com) you agree to these terms and conditions, which constitute our agreement.

1.    Trip Suppliers:  You acknowledge that all excursions booked through the Company are provided by independent contractors of the Company. Company does not act on behalf of, control or supervise the parties, entities, or persons who own, provide, or operate such excursions, events or activities as independent contractors.  The Company has no authority to control or direct any aspect of the independent contractors' services.

2.    Age Restrictions: Persons under the age of 18 are prohibited from registering for, purchasing, or modifying any service or service options offered on this Site. By using this site, you attest that you are of legal age and that you have the power to enter a binding contract.

3.    Supplier Terms & Conditions: You agree to abide by the terms and conditions of the Suppliers you book with, including, but not limited to, timely payment of all amounts when due and to comply with the supplier’s rules, restrictions and regulations.

4.    Availability/Confirmations: Your reservation is considered booked and confirmed once Supplier availability is confirmed, you complete the appropriate payment process and receive a confirmation email to the email address you provide in the booking process. Your reservation confirmation email will include: name of excursion reserved, date of the excursion, number of guests, deposit placed for the excursion, money due to supplier at time of excursion, and detailed departure time & location information. Confirmation emails must be presented at the time of the excursion to the Supplier.

5.    Pricing: The prices listed on the excursion reservation, unless otherwise specified, are per person. If the price is for a group rate the number of participants will be listed on the reservation. There will be no adjustments to the price if less participants showing on the reservation show for the trip. The listed price does not include tips or gratuities, personal items or any food or beverages not listed as included in the excursion. You will pay the Supplier the amount indicated on the trip reservation plus any applicable taxes and other fees. Prices reflected on the site are in United States Dollars. You are responsible for any currency exchange rate applies at time of purchase.

6.    Deposits/Balances Due: A 20% deposit will be charged to your card at the time of booking after availability is confirmed. The balance due on your excursion will show on your trip reservation.  The balance due must be paid at the time of the excursion in one lump sum unless the Supplier agrees to other terms.

7.    Cancellation/Changes: The Company and Suppliers reserve the right to make changes to any excursion without prior notice and shall not be liable for any loss whatsoever to Customer due to an excursion cancellation.  These changes are usually made at the Suppliers request due to safety or issues beyond their control. If you do not agree to the change, please do not take the excursion.  No refund will be given if you participate in the excursion.  In the event you do not accept the change and do not participate in the excursion and are requesting a refund please notify the Company within 14 days of the date of the excursion. If you wish to cancel a reservation you may do so within the cancellation period listed on the reserved excursion which is also listed on your reservation confirmation email. You may contact the Company at reservations@sxmexcursions.com or the number listed on your reservation to request changes to a reservation made through the Company. Any requested change is subject to availability, and we cannot guarantee that we will be able to make a requested change.

 

8.    Refund Policy:  All refund request must be sent to the Company within 14 days of the date of the excursion by email to reservations@sxmexcursions.com


You will receive a full refund if:
•    the excursion is cancelled by the company or Supplier due to weather conditions or other reasons. 
•    If you are a cruise ship passenger and your ship does not arrive in the port of Philipsburg, St. Maarten.

•    Cancel within the cancellation period listed on your confirmation email.


Refunds will not be issued if:​

•    Do not show up to the excursion at the designated time and location or who leaves during the excursion. The Company is not responsible for transportation costs if the customer chooses to abandon an excursion.

•    Cancel after the date listed in the cancelation policy for your reserved excursion.

•    Choose not to participate in an excursion due to weather conditions.

9.    Injury, Loss of Personal Items, Late Arrival: The Company is acting as a booking agent and is therefore is not responsible for injuries, accident, damage, death, loss of personal property, costs incurred or paid, or late arrival to the reserved trip. If any of these events occur on your excursion you will be referred to the Supplier. Notwithstanding anything to the contrary contained in these Terms and Conditions, our liability to you in respect of any loss or damage suffered by you and arising out of or in connection with these Terms and Conditions, shall in no event exceed the amount of any payments made by you to Company.
